The employer's power to resort to a private investigator can be exercised in two cases: when there is clear evidence of misconduct by the employee; or when there is a mere suspicion that the employee's misconduct has been or is about to be committed (Cass. 21621/2018).
Indeed, case law has now recognized the legitimacy of resorting to private investigators by the employer to confirm suspicions about employees' commission of misconduct against the company's assets and reputation. These are checks that are not attributable to either the scope of application of Art. 4 of the Labor Code or the scope of application of Art. 3 of the Labor Code, as they do not concern the correct performance of the work performance stipulated in the contract, but rather illicit behaviors that undermine the employer's trust.
The activity of the private investigator is primarily used in judicial proceedings, both civil and criminal. At the end of the investigation, the private investigator prepares an investigative report that can be used in court, to which any photographs and videos taken during the investigation may be attached. In addition to these pieces of evidence, investigative agents who have personally participated in the investigation may also testify in court.
